Estate Recovery

Allows Social and Rehabilitation Services (SRS) to be reimbursed for Medicaid funds paid in support of any individual age 55 or older that has received long term care and/or nursing facility care after 6/30/92.  After the death of both the recipient and their spouse and all funeral expenses are paid, SRS has first class claim against the estate for the amount provided for care.  (All medical expenses paid by SRS and any other Medicaid expenditures may be included.)  Recovery is reduced by the value of benefits paid through long term care insurance.  If there is a child under age 21 or a permanently and totally disabled adult child, Estate Recovery will not be made.
